TCS Nashik Case: SIT Forms 3 Teams To Track Down Absconding Accused Nida Khan
SIT forms 3 teams to trace the absconding TCS Nashik accused Nida Khan as the court defers her bail plea to April 27.
The Court of Sessions in Nashik refused to issue an interim stay on arrest against Nida Khan, one of the accused in the high-profile case related to sexual harassment and religious bullying in the Nashik office of Tata Consultancy Services. The court has now ordered the police to file its reply to the application of Khan, who applied to the court for anticipatory bail. The next hearing in the case is scheduled on April 27.
Plea and Process Before The Court
Khan had already petitioned the court for anticipatory bail on Saturday, one of the important reasons being her pregnancy that had been continuing for two months. During the proceedings, her attorney, Rahul Kasliwal, made a passionate plea for interim relief that could save her from arrest until a final verdict was reached regarding her bail. However, Additional Sessions Judge KG Joshi did not give any interim relief to her and instead ordered the police as well as the complainant to appear at the next date.
SIT Steps Up Investigations
The SIT created by the police force of Nashik is thoroughly investigating the matter; there are nine FIRs filed regarding molestations, harassments, and intimidations. The authorities have initiated a statewide manhunt for Khan, using numerous teams for the search all over Maharashtra. To date, eight people have been detained regarding the matter, one of whom is a female operations manager from the TCS Nashik branch.
Nature of the Claims
The claims leveled against Khan and other suspects are grave and varied. According to official statements from the police department, she allegedly used her WhatsApp group to harass her employees and force them to follow certain religious rules. This included making them pray in a certain way and eat meat against their will.
Some victims have stated that they were forced to adopt certain religious customs like altering their eating habits, taking part in religious prayers, and wearing symbols that belong to a specific religion.
Legal Charges and Defence Argument
Khan is being accused of committing various offenses under several provisions of the Bharatiya Nyaya Sanhita (BNS). These include sexual harassment and defamation cases. There are also several charges against Khan under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
The defense has claimed that the SC/ST Act cannot be invoked in this case since there have not been any allegations of abuses or insults on the basis of caste. The SC/ST Act requires the occurrence of certain offenses before it can be enforced.
Arrest of Other Accused and Judicial Detention
Another significant development is that two other accused, namely Raza Rafiq Memon (age 35) and Shafi Bikhan Sheikh (age 36), have been put under judicial detention for 14 days in a magistrate court. The rest of the accused who are already in custody are also under judicial detention.
Response from the Company and Other Considerations
As a reaction to this commotion, Tata Consultancy Services has maintained that their policy is zero tolerance for harassment and intimidation in the workplace, and employees implicated in such misconduct have already been suspended pending further investigation. Not only does this issue pose ethical questions regarding workplace conduct, but it also draws attention to the rights of workers and the need for secure workplaces. Pending investigations, this case is bound to have far-reaching implications on corporate governance within the Indian IT industry.
